DESCRIPTION:Join us for our annual conference\, Mediate 2023\, for an opportunity to explore the practice of mediation\, renew connections and make some new ones. \nKeynote Speakers: \nGerry O’Sullivan: \nWorking with the Thoughts of a Mediation Participant: The Context\, Reason\, How and Results \nThere are times when we need to facilitate parties to stay on their track of thinking and travel the journey of their thoughts. But this is often not as simple as we mediators think it is as we are inclined to ask default or habitual questions that are informed by our own thoughts and these may interfere with our client’s train of thought.  \n My own default question is/was: ‘And what was that like for you?’! If you developed a default question\, think about what it is? \nThis presentation will cover the communication context in which we mediators work\, the reason for asking mediation questions\, how to do it effectively and why it works. This theory will be illustrated by a brief filmed role play and then tips on how to ask challenging questions safely. \nGerry has 35 years’ experience in conflict and mediation work\, training design and delivery\, and facilitation. She has published a book titled: ‘The Mediator’s Toolkit: Formulating and Asking Questions for Successful Outcomes’ and developed online training materials to accompany it\, including many filmed role play demonstrations. \nGerry delivered Mediators’ Institute of Ireland (MII) accredited Certified Mediation Training for many years. \nFor more information: www.osullivansolutions.ie \nJohn Lande: \nWhy Do You Mediate the Way You Do? \nMediators’ procedures vary widely based on many factors such as their personal histories\, values\, goals\, motivations\, knowledge\, and skills as well as the parties and the cases in their mediations. Mediators develop categories of cases\, parties\, and behavior patterns that lead them to design routine procedures and strategies for dealing with recurring challenges. These may become second nature so that mediators aren’t conscious of them after a while. \nMediators attending this program will be guided through an exercise to become more aware of the factors leading you to mediate as you do. You should bring a laptop or pad of paper so that you will develop an outline of what Prof. Lande calls your “mediation practice system.” The audience will discuss similarities and differences in the factors affecting their mediation procedures and the procedures themselves. \nYou might want to read some of Prof. Lande’s publications before the program. Here’s a link to a series of short blog posts summarizing different parts of his analysis as well as a law review article that integrates them\, Real Mediation Systems to Help Parties and Mediators Achieve Their Goals.  \nWorkshops: \nLearning from different ways of assessing a mediators’ competence\nI have been assessed as a family mediator in Scotland for the LSS and in England for the FMC\, as a commercial mediator in Scotland\, as a community mediator in Scotland and New York and as a SEND mediator in England and Scotland. What I have learned and what might be useful to others. \nWorkshop led by Ewan Malcolm\nEwan Malcolm has been Chief Executive of Relate in London North West\, Hertfordshire\, Mid Thames & Buckinghamshire since 2013.\nPreviously\, Ewan practiced as a solicitor and as a mediator. From 1989 to 2002 he was a partner in a Scottish law firm. In 2002 he established Scottish Mediation in Edinburgh and was its Director until 2009 when he moved to London. From 2010-13 he lived in New York City where he ran the Manhattan Civil Court mediation service.\nEwan first trained as a commercial mediator in 1995\, then as a family mediator the following year\, as a community mediator in 1999 and also as an SEN mediator. He holds a Masters degree in Conflict Resolution & Mediation. Ewan has served as Chair of the College of Mediators and was on the Board of the Family Mediation Council.\nEwan was named Mediator of the Year at the Law Awards of Scotland in 2008 and received the 2018 National Mediation Unsung Hero Award. \nKeeping Families Together – A child’s-rights based approach to Mediation.\nCyrenians’ ‘Keeping families together project’ works across Scotland’s four secure units. We offer whole family support and family mediation at what can often be the most challenging period in a family’s life. Join Cyrenians mediation team for this unique event; part workshop and part theatrical experience\, to imagine mediation as an invaluable tool in ensuring children’s rights are met\, no matter the difficulties families are facing.\nWorkshop Led by Alan Jeffrey\nAlan Jeffrey has worked for Cyrenians\, a local charity tackling the ‘causes and consequences of homelessness’ since 2014. Alan has recently completed an MSc in Mediation & Conflict Resolution and is the Senior Mediator for Cyrenians: mediation and support. Alan\, alongside his highly trained and skilled team are dedicated to further developing mediation as a tool for keeping families together\, improving relationships\, and encouraging collaboration. \nEmbedding Inclusion and Intersectionality in Mediation Practice\nThis workshop discusses how intersectionality can inform efforts to achieve greater inclusion in mediation and be used as a powerful tool in conflict analysis. As such\, the workshop explores how facilitators can ensure that diverse identities are recognised in mediation processes\, whilst also examining some of the barriers to increasing diversity amongst trained mediators.\nThe workshop will cover what inclusion and intersectionality mean in the context of mediation practice. Then\, from a practical perspective\, it will look at how dominant approaches and language can influence a sense of inclusion\, and lack thereof\, within mediation processes.\nOverall\, the workshop illustrates how an intersectional perspective can inform a deeper understanding of conflict dynamics and disputes which is attentive to power differentials. Mediators will be encouraged to reflect on how they can embody intersectionality in their practice and build on this perspective to better support parties’ abilities to engage in the mediation process.\nThe workshop is delivered by Dr Maria-Adriana Deiana and Dr Heidi Riley who are co-investigators of the project Talk4Peace.\nThe project explores the role of transformative mediation practices as mechanisms for peacebuilding internationally and on the island of Ireland.\nMaria is a Senior Lecturer in International Relations and the co-director of the Centre for Gender in Politics at Queen’s University Belfast. Her research interests sit at the intersection of feminist international relations\, critical peace and conflict studies\, and border studies. She has published on the everyday\, affect and aesthetics in conflict; on the politics of gender and feminist activism in contexts shaped by armed conflict\, international intervention and peacebuilding\, and on EU border politics\, peace and security. \nHeidi is a Research Fellow in the School of Politics and International Relations\, University College Dublin. Her research straddles multiple areas of peace and conflict scholarship\, including insurgency and ideology\, gender and masculinity\, peace mediation\, and conflict-related trauma. She has published on masculinity in armed groups with a specific focus on Nepal\, UNSCR 1325 on Women Peace and Security\, women in mediation\, and NGO approaches to conflict-related trauma. \nDialogue on the mediation in the time of war\nNext February 24th will be the second year of a full-scale Russian Federation war against Ukraine. As the war is ongoing the discussion on establishing peace takes place in expert circles and at the international level.\nIn order to foster an understanding\, learning and contribution to peace we would like to share where we are now and what perspectives on establishing peace.\nPotential possibilities for negotiation have been lost with the complete escalation of the war. Nor Ukraine is ready to sacrifice its people\, territory and sovereignty\, nor Russia is ready to get back occupied territories and recognize its defeat in Ukraine. There are a lot more dimensions to discuss\, as well as strategies and approaches worth thinking about.\nIt is a turning point in our-story and the future of the XXI century. We feel responsibility for the choice to be made. SUMMARY:Masterclass: The Honour Dimension to Conflicts
DESCRIPTION:The purpose of this online seminar is to: \n\nRaise awareness of the terms ‘izzat’\, ‘namus’ or ‘honour’ and the influence of this concept on those from ‘honour’ communities\nIdentify some of the signs of honour based abuse and violence (HBA/HBV) – when mediation may not be appropriate\nConsider circumstances when honour is present but where mediation could be possible\n\nIn June 2022\, Sweden made honour based violence (HBV) and honour based abuse (HBA) a specific crime. In Scotland\, there is no such specific crime. HBA is a form of gender-based violence and according to Police Scotland: “The term Honour Based Abuse (HBA) embraces a variety of incidents or crimes including physical abuse\, sexual abuse\, emotional abuse\, abduction\, forced marriage\, imprisonment and murder (not an exhaustive list)\, where the individual\, their family or community is punished for actually\, or allegedly\, undermining what the family or community believes to be the correct code of behaviour and which could bring shame to the family or community.” \nIt is more common to hear and associate the term ‘honour’ in the context of ‘honour’ killing and violence. However\, the so-called notion of ‘honour’ is complex – and its influence on attitudes\, behaviour and relationships can have far reaching consequences. ‘Honour’ codes are more prevalent among some Black Asian and Minority Ethnic (BAME) communities. In 2014\, a survey of 300 BAME residents in Edinburgh found that more than 52% said honour would prevent them from reporting a crime and 63% said honour was part of their family belief system (This survey was conducted by Edinburgh and Lothian Equality Council). \nIn light of the above\, there is a real potential that ‘honour’ could be present in cases that mediators handle. To preclude mediation in all cases when there is an element of honour to the conflict denies the individuals and communities of this effective means of conflict resolution. Mindful of how quickly risks can escalate\, this seminar provides an opportunity to discuss and consider circumstances where mediation could be undertaken\, safely. \nGithathevi Kanisin bio: \nGitha’s early career was in legal practice\, with an LLM from University of Cambridge. DESCRIPTION:What is intersectionality and why is it important? \nAre you aware of the way in which different types of discrimination (= unfair treatment because of a person’s sex\, race\, etc.) are connected to and affect each other. Attend this CPD event to find out more. \nPeople who belong to more than one marginalised group (eg LGBTI\, disabled\, neurodivergent\, Black\, Asian and minority ethnic) face multiple oppressions\, discrimination and barriers\, including erasure and exclusion from our own communities.. This is often reflected in organisations that primarily focus on one protected characteristic and may not have the necessary knowledge to help service users with the barriers they may face because of the intersecting aspects of those identities. DESCRIPTION:Join us for our annual conference\, Mediate 2022\, for a day of listening\, learning\, connecting and reflecting. The event will include the following: \nKeynote Speakers: \nKathryn Mannix\, who believes that bringing ourselves into conversations that we perceive as ‘tender’ rather than ‘difficult’ can help us to be companions to people in distress. Rather than ‘fixing\,’ we can validate their experience and help them to be authors of their own solutions. \nDr Gurchathen S Sanghera FRSA: \nFuture Challenges for Mediation in Scotland. \nGurchathen joined the School of International Relations in 2007 and is a Senior Lecturer. Gurchathen’s research explores the complexities of social justice and\, in particular\, the discursive and material reproduction of marginalisation and exclusion globally\, nationally and locally. More specifically\, his research is concerned with examining the ways in which various forms of discrimination intersect (for example caste\, class\, gender\, geographical\, sexual\, religious) to shape people’s everyday lives and how\, in turn\, people respond to such processes. This work draws on empirical research and is also informed by theoretical debates. He has conducted extensive fieldwork in India\, Liberia\, Haiti\, and the UK (Bradford and Scotland) \nWorkshops: \nPeer Mediation (Kathryn Hilditch) –  Scottish Mediation has recently been working across Fife council and developing a new model of Peer Mediation delivery to support this. What have we learned? What have we changed? What’s the future? \nWhat happens when mediations get stuck (Tony Buon) – It can be challenging and frustrating for all when mediation gets stuck. In this interactive session\, Tony will explore what mediators can do to help the parties move forward.  \nAdapting Practice (Charlie Irvine)–  Does one size fits all when mediating? How might you adapt your mediation process and style to fit different types of cases? \nConflict Avoidance in the construction industry (Len Bunton) –  A big focus in the construction industry is a switch in focus from Dispute resolution to conflict avoidance. SUMMARY:Masterclass in Trauma\, Human Development and Personality Disorders
DESCRIPTION:A Masterclass that will discuss how Trauma\, Human Development and Personality Disorders can affect participants’ ability to engage in face-to-face conversations. \nThis half day CPD workshop is likely to appeal to frontline workers who experience challenging presentations within the face to face work they undertake with clients. The focus will be on recent or historic traumatic experiences and the impact that these may have on personality functioning. Links will be made with trauma experiences\, their biopsychosocial impact and the potential contribution to personality disorder. The main personality disorder types will then be presented and ways that frontline staff may respond to these clients in a trauma informed manner clarified. \nThe workshop will be presented by Andy Gray. Andy is the Company Director of ACT Counselling Services Ltd and a retired Psychotherapist. He has over 25 years of experience in the helping professions including; Psychiatric Hospital Management\, Social Work settings\, Private Practice\, and has taught in various universities and private training providers across the UK. SUMMARY:The Singapore Convention on Mediation
DESCRIPTION:We are delighted to host this seminar in conjunctions with the Young Mediators Group. \nThe Singapore Convention on Mediation was opened for signature in 2019 and to date has 55 signatories across the globe. the Convention is a uniform and efficient framework for international settlement agreements resulting from mediation. It applies to international settlement agreements resulting from mediation\, concluded by parties to resolve a commercial dispute. \nThe UK government is currently consulting on whether the UK should sign up to the convention so now is a great time to be holding our discussion. \nOur guest speaker is Professor Bryan Clark from the University of Newcastle. Bryan joined the Law School in April 2019 as a Professor having previously spent 15 years at the University of Strathclyde in Glasgow where I was Head of School from 2013-2016. Bryan is a socio legal scholar with interests in mediation and alternative dispute resolution and in particular how these processes interact with formal civil justice and the workings of lawyers and judges. SUMMARY:Mediate 2021 Conference - Changing the Frame\, Framing the Changes
DESCRIPTION:We’re delighted to announce details of our 2021 annual conference\, Mediate 2021 on Monday 15th November 9.00am-1.00pm and Tuesday 16th November 1.00pm-5.00pm. \nTaking place over two half days our theme this year is abut Changing the frame of mediation in order to widen engagement with it across society. On Monday we hear from David Liddle who is not only a successful author on management and organisations but also CEO of the TCM group delivering workplace mediation across the UK. `We finish the day with a panel discussion on what we have learned from online mediation and what the future holds. On the Tuesday we welcome Liz Stokoe Professor of Social Interaction at Loughborough University. Her recent research relates to what many view as core aspects of mediation practice\, rapport building and the use of open questions. We’re sure that what she has to say will raise some eyebrows and challenge our views. We finish the conference with the person who has provided the inspiration for our theme\, Dr Anna Howard.
