DESCRIPTION:Join us for our annual conference\, Mediate 2022\, for a day of listening\, learning\, connecting and reflecting. The event will include the following: \nKeynote Speakers: \nKathryn Mannix\, who believes that bringing ourselves into conversations that we perceive as ‘tender’ rather than ‘difficult’ can help us to be companions to people in distress. Rather than ‘fixing\,’ we can validate their experience and help them to be authors of their own solutions. \nDr Gurchathen S Sanghera FRSA: \nFuture Challenges for Mediation in Scotland. \nGurchathen joined the School of International Relations in 2007 and is a Senior Lecturer. Gurchathen’s research explores the complexities of social justice and\, in particular\, the discursive and material reproduction of marginalisation and exclusion globally\, nationally and locally. More specifically\, his research is concerned with examining the ways in which various forms of discrimination intersect (for example caste\, class\, gender\, geographical\, sexual\, religious) to shape people’s everyday lives and how\, in turn\, people respond to such processes. This work draws on empirical research and is also informed by theoretical debates. He has conducted extensive fieldwork in India\, Liberia\, Haiti\, and the UK (Bradford and Scotland) \nWorkshops: \nPeer Mediation (Kathryn Hilditch) –  Scottish Mediation has recently been working across Fife council and developing a new model of Peer Mediation delivery to support this. What have we learned? What have we changed? What’s the future? \nWhat happens when mediations get stuck (Tony Buon) – It can be challenging and frustrating for all when mediation gets stuck. In this interactive session\, Tony will explore what mediators can do to help the parties move forward.  \nAdapting Practice (Charlie Irvine)–  Does one size fits all when mediating? How might you adapt your mediation process and style to fit different types of cases? \nConflict Avoidance in the construction industry (Len Bunton) –  A big focus in the construction industry is a switch in focus from Dispute resolution to conflict avoidance. Where does mediation fit with this\, what’s involved and are there lesson for other sectors? \nMediators Green Pledge – Led by Emma Anstead the workshop will examine how mediators can take practical steps to reduce the environmental impact of their practice.  \nUsing Mediation at Protests and Demonstrations – Exploring how mediation can be applied in the context of live protests and demonstrations.  \nAdditional: \nPanel discussion and social gathering at the end of the day. SUMMARY:Duties and Dilemmas: The Practical Application of Ethics in Mediation
DESCRIPTION:This seminar will combine a modest amount of talk and electronic chalk with scenarios and tricky questions. The aim is to encourage us to reflect and share what each of us would do when faced with an ethical dilemma in a mediation\, and why. \nWe will set the scene\, connecting ethical frameworks with the fundamental principles of mediation. We will then go on and explore how different ethical duties may come into tension in hard cases\, and explore how each of us might try to manage or resolve such tensions. \nWhile the dilemmas may be easy to answer at the extremes of black and white\, it may be that the trickier cases in the middle contain many more shades of grey. \nWho: The session will be led by Craig Cathcart\, mediator and Senior Lecturer in Dispute Resolution at Queen Margaret University\, Edinburgh. SUMMARY:The Singapore Convention on Mediation
DESCRIPTION:We are delighted to host this seminar in conjunctions with the Young Mediators Group. \nThe Singapore Convention on Mediation was opened for signature in 2019 and to date has 55 signatories across the globe. the Convention is a uniform and efficient framework for international settlement agreements resulting from mediation. It applies to international settlement agreements resulting from mediation\, concluded by parties to resolve a commercial dispute. \nThe UK government is currently consulting on whether the UK should sign up to the convention so now is a great time to be holding our discussion. \nOur guest speaker is Professor Bryan Clark from the University of Newcastle. Bryan joined the Law School in April 2019 as a Professor having previously spent 15 years at the University of Strathclyde in Glasgow where I was Head of School from 2013-2016. Bryan is a socio legal scholar with interests in mediation and alternative dispute resolution and in particular how these processes interact with formal civil justice and the workings of lawyers and judges. DESCRIPTION:We’re delighted to announce details of our 2021 annual conference\, Mediate 2021 on Monday 15th November 9.00am-1.00pm and Tuesday 16th November 1.00pm-5.00pm. \nTaking place over two half days our theme this year is abut Changing the frame of mediation in order to widen engagement with it across society. On Monday we hear from David Liddle who is not only a successful author on management and organisations but also CEO of the TCM group delivering workplace mediation across the UK. `We finish the day with a panel discussion on what we have learned from online mediation and what the future holds. On the Tuesday we welcome Liz Stokoe Professor of Social Interaction at Loughborough University. Her recent research relates to what many view as core aspects of mediation practice\, rapport building and the use of open questions. We’re sure that what she has to say will raise some eyebrows and challenge our views. We finish the conference with the person who has provided the inspiration for our theme\, Dr Anna Howard. SUMMARY:Reflective Practice – The Road from Basic Training to Artistry
DESCRIPTION:This Scottish Mediation seminar (run by Roy Poyntz\, biography in link below) will build on the foundations laid in our earlier June 2021 meeting\, although you don’t have to have attended: all welcome. It will be a highly interactive encounter with reflective practice using exercises\, group work and applications. It will be of relevance to mediators of all levels of experience and to those who practice as co-mediators and/or solo. \nArgyris and Schön – two leading scholars in the field – propose that reflective practice is a route for a professional to construct their own personal theory of practice. We will explore this concept and how it leads to an assurance of competence whilst also representing what makes each of us distinctive. SUMMARY:Peer Mediation - Adult Skills Training
DESCRIPTION:This online skills development course taking place over two sessions (2 hours each session) will enable participants to deliver peer mediation training to children and young people aged 10 to 18 years. It will provide tools and techniques that will equip participants to feel confident in training and supporting young people as peer mediators.  \nPeer mediation is a technique using a 5-stage model which enables children and young people to help their peers to resolve disagreements in a constructive and non-violent way. Peer mediation training is a fun and interactive programme which can be delivered in a wide variety of different settings including schools\, youth clubs and other settings where young people meet. Research and our experience suggests a hugely positive impact upon young people which can directly impact their confidence\, communication and conflict resolution skills which has been proven to raise attainment.  \nThis course would be of particular interest to those working with children and young people who are keen to set up a peer mediation scheme within their setting. SUMMARY:Mandatory Mediation in Ontario\, Canada: Popular 20 Years On
DESCRIPTION:Nearly 20 years ago\, mediation became a required step in most civil litigation proceedings in three major Ontario cities. It was then shown to decrease time to settle cases\, decrease cost to litigants\, and increase satisfaction among lawyers and parties\, among other benefits. Jennifer Egsgard is an Ontario lawyer and mediator that for 2 years has chaired a committee of the Ontario Bar Association looking at whether mandatory mediation ought to be expanded. The committee surveyed the views of Ontario lawyers\, obtaining detailed insight into current views of mandatory mediation\, which included overwhelming support for its expansion. The Ontario government is now considering expanding mandatory mediation to more areas of the Province\, based partly on the Ontario Bar Association’s recent recommendation. Ms. Egsgard will explain how mandatory mediation works in Ontario\, and will provide details about the results of an initial evaluation as well as current lawyer views. \n  \nJennifer Egsgard Biography: \nJennifer Egsgard is a mediator with Egsgard Mediation. Currently based in London\, Ms. Egsgard was called to the Ontario Bar in 2002. Ms. Egsgard worked as a barrister and solicitor for 6 years in the litigation department of a large Canadian national firm\, Fasken\, and later in a smaller firm that she started with a senior colleague\, Sills Egsgard LLP\, before starting Egsgard Mediation in 2018. She has completed the Harvard Mediating Commercial Disputes Course\, and awaits results from the CEDR Mediation Skills Course. She has delivered talks on Ontario’s mandatory mediation program\, including to the UK Civil Justice Committee\, Judicial ADR Liaison Committee\, as well as at a webinar with 500 participants from around the world. \nEvent will take place on Tuesday 9th March\, from 5pm-6pm. Who should make and receive an apology? and Is there an optimal time for making an apology? The workshop will draw on research and practice\, with mediators being invited to share experiences and discuss approaches. \nCarolyn Hirst’s Biography: Carolyn is an independent consultant with her own business\, Hirstworks. A registered mediator\, she is the mediation practice supervisor for Cyrenians and mediates for the Scottish Legal Complaints Commission and Edinburgh Sheriff Court. She is a Non-Executive Board Member of NHS Lothian\, the Vice-Chair of Midlothian Integration Joint Board and a Trustee of the Edinburgh and Lothians Health Foundation. Carolyn previously worked part-time as a Lecturer in Ombudsman and Complaint Handling Practice at Queen Margaret University. SUMMARY:Peer Mediation Training for Trainers Online 22nd and 29th September 2020
DESCRIPTION:This online Training for Trainers course taking place over two sessions (2 hours each session) and will enable participants to deliver peer mediation training to children and young people aged 10 to 16 years. It will provide tools and techniques that will equip participants to feel confident in training and supporting young people as peer mediators. \nPeer mediation is a technique using a 5-stage model which enables children and young people to help their peers to resolve disagreements in a constructive and non-violent way. Peer mediation training is a fun and interactive programme which can be delivered in a wide variety of different settings including schools\, youth clubs and other settings where young people meet. Research and our experience suggests a hugely positive impact upon young people which can directly impact upon raising attainment. \nThis course would be of particular interest to those working with children and young people who are keen to set up a peer mediation scheme within their setting. Previous experience of mediation is not required. \nParticipants will receive a toolkit of material which includes all of the games and activities to deliver peer mediation training and more. \nCourse aims: \n\nTo develop participants’ understanding of the concept of peer mediation and explore the benefits to young people’s personal development\nTo support participants to develop confidence in training young people to fulfil the role of peer mediators\nTo give participants the tools to develop a peer mediation service within their setting and to provide support for peer mediators\nTo explore the additional benefits of peer mediation to the wider environment\n\nCourse Objectives: \n\nTo expand the network of peer mediation trainers in Scotland\nTo provide more children and young people with opportunities to experience peer mediation training\nTo help raise children and young people’s resilience\, self-esteem and confidence\n\nCourse Dates: \nThere are two date options available as outlined below. Please note that you would need to be able to attend both sessions 1 and 2 to get a certificate of training. \nCourse 1 dates: \nSession 1: Tuesday 25th (10-12noon) and Session 2: Thursday 27th August 2020 (10am – 12noon) \nor \nCourse 2 dates: \nSession 1: Tuesday 22nd September (10-12noon) and Session 2: Tuesday 29th September 2020 (10-12noon) \nThis event will be delivered online via Zoom.
