Learning from International Best Practice: Brazilian Reflections on the One-day Model and Process Design

Marcelo Perlman, a Brazilian mediator with an international commercial practice and Shona Crallan, a Scottish mediator who lives and works in London and Brazil will discuss the comparative approaches to mediation in Brazil and the UK with a particular focus on process design. What can we learn from the Brazilian practice of holding mediations over a period of weeks or months compared to the standard UK one day model? Shona and Marcelo will discuss a comparative approach to process design including consideration of preparation, developing trust and rapport, exploration of interests and issues, creating flexibility, dealing with emotions, process time and educating parties and lawyers.
